Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms of sales, which together with our terms and conditions, our privacy policy and website disclaimer, govern minjums.com.au’s relationship with you in relation to your use of this website.

By using this website, you signify your acceptance of these terms and conditions of sale. For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to minjums.com.au and “You” and “Your” refers to you, the client, visitor, website user or person using our website.

AMENDMENT OF TERMS

We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and minjums.com.au’s rights and obligations to each other.

COMPETITION AND CONSUMER ACT

For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), minjums.com.au’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

You must be over 18 years of age to use this website and to purchase any goods or services.

PRODUCTS, ORDERS AND PAYMENT

Delivery is only be available to some areas of METRO MELBOURNE. This is due to the need to be a chilled product.  

Your order will be delivered in an insulated container in order to keep your products cold during transit.  Please refrigerate the products immediately upon receiving.

You must provide us with accurate delivery information. We will only deliver to a physical address (Delivery Address). We do not deliver to P.O. boxes.

Deliveries are on Tuesday and Friday from 9am to 3pm for selected Melbourne Metro suburbs.

If ordered before Monday 2pm products will be delivered on Tuesday  between 9am and 3pm or before Thursday 2pm products will be delivered on Friday  between 9am and 3pm depending of the suburb you are located. We will send you an email or SMS to confirm when your order will arrive.

We will not be liable for any cost, loss or damage caused by a delay in delivery, including incorrect delivery details provided by you and/or not following the refrigerated instructions.

We will not be liable for any cost, loss or damage caused by delivery details provided by you that do not fall within the specified areas of delivery for that particular product.

You agree to take on the risk for the goods, such as loss or damage, when the goods reach the Delivery Address.

We also offer a pick up option. We will email and/or SMS you to arrange pick up time.

DELIVERY

Delivery is only be available to some areas of METRO MELBOURNE. This is due to the refrigerated conditions that our fresh sweet spreads need.

Your order will be delivered in an insulated container in order to keep your products cold during transit.  Please refrigerate the products immediately upon receiving.

You must provide us with accurate delivery information. We will only deliver to a physical address (Delivery Address). We do not deliver to P.O. boxes.

Deliveries are on Tuesdays and Fridays from 9am to 3pm for selected post codes of Greater Melbourne.

Depending on the post code, the product will be delivered on Tuesday or Friday. Orders need to be placed before 2pm one day before of the delivery day for the corresponding post code.

We will send you an email or SMS to confirm when your order will arrive.

We will not be liable for any cost, loss or damage caused by a delay in delivery, including incorrect delivery details provided by you and/or not following the refrigerated instructions.

We will not be liable for any cost, loss or damage caused by delivery details provided by you that do not fall within the specified areas of delivery for that particular product.

CANCELATIONS

Orders placed may be cancelled prior to the order being shipped, however, this may entail a cancellation fee to cover the cost of any transaction fees and time required to complete any refund.

RETURNS, REFUNDS AND EXCHANGES

minjums.com.au handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

You shall inspect the goods immediately upon their arrival and shall within 24 hours give notice to us by email us at hello@minjums.com.au if the goods are not in accordance with specified requirements. If you fail to give such notice, the goods shall be deemed to be in all respects in accordance with the specified requirements.

No claim shall be recognised unless made in writing and received by us to our email at hello@minjums.com.au within 24 hours after receipt of goods by you. Photos & details will be requested, so please include in your email.

The total amount of any claim shall not exceed the actual invoice value of the goods claimed to be faulty.

You may seek a refund for goods purchased from us if the product is faulty through no fault of your own, or if it does not match our product description.

You may also be asked to demonstrate that the problem with the goods was not your fault.

 

If you prefer an alternative to a refund we can arrange for goods to be exchanged or repaired. A credit to be used on other of our products may be offered at our discretion.

Please choose carefully as you are not entitled to a refund if you simply change your mind.

We do not accept returns due to our products being perishable. 

EXCLUSION OF UNENFORCEABLE TERMS

Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

JURISDICTION

This agreement and this website are subject to the laws of Victoria and Australia. If there is a dispute between you and minjums.com.au that results in litigation then you must submit to the jurisdiction of the courts of Victoria.
